The MTN Group has reportedly hired former US attorney-general, Eric Holder to take part in talks with Nigerian regulators about settling a $3.9bn fine, according to the Nigerian Communications Commission.
Mr Holder held preliminary talks with Nigerian Communications Commission CEO Umaru Danbatta regarding the record penalty, which was imposed on Africa’s largest wireless company for missing a deadline to disconnect unregistered subscribers, the regulator’s spokesman, Tony Ojobo, said on Wednesday. The Financial Times earlier reported Mr Holder’s involvement.
“We have consultants working for us across the globe,” MTN spokesman Chris Maroleng said, declining to comment on Mr Holder.
MTN shares had gained 0.4% to R126.14 by 11.52am in Johannesburg, reducing the decline since the fine was made public on October 26 to 34%. That values the company at R233bn.
The penalty was originally set at $5.1bn before an appeal by MTN led to a reduction of 25%. A Lagos court said January 22 that the matter would be adjourned until March 18, allowing the two parties to reach an agreement.
Mr Holder, a partner at Washington DC-based law firm Covington & Burling, advises clients on litigation matters, including those that are international in scope and involve significant regulatory and reputational concerns, according to the company’s website. NCC has to put the national interest in mind. Am no fan of MTN, their service SUCKS if you ask me. However, they are one of the few companies that are providing employment for thousands of Nigeria and enhancing small communication business opportunities.
If you throw the book at them, these same poor Nigerians will suffer in the end so let us tamper mercy with justice. Get MTN to pay something sizeable to serve as a future deterrent to others and let us move on.
Also get MTN to give undertaking that their NETWORK service will not go MORIBUND as it is now in most part of ONDO STATE and possibly elsewhere, commit them to writing and let the whole world know. Better and efficient communication will help the country in reconfiguring its economic strategies into the near future so, please, you can consider this writeup as a PLEA FOR MERCY!!
